California Bicycle Accident Attorney-
Injury Lawyer

Given its diverse and expansive landscape of everything from snow-capped Sierra mountains to beautiful lush valleys and rolling hillsides, it’s no wonder bicycle riding in California continues gaining in popularity. With the greater number of bicycles on our roadways comes the unfortunate increasing number of bicycle-related accidents and injuries. In fact, California routinely has the highest number of bicycle-related fatalities of any state in the U.S. accounting for nearly 20% of all deaths. Though California’s safety laws have been effective in reducing the severity of injuries resulting from bicycle accidents, bicycle accidents continue at an increasingly alarming pace.

In 2014, California passed a law requiring drivers to give bicyclists at least three feet of space on our roadways. Here are the specifics of this law:

  1. The law applies to any place a vehicle passes a bicyclist, regardless of whether there is a marked bicycle lane.

  2. A law enforcement officer must witness the violation in order to issue a fine.

  3. Violators face a minimum $35 fine and $220 fine if a collision occurs. Both fines can increase when court fees are added.

  4. The exception to this law is if there isn’t enough room for a driver to give three feet of space, it must first slow down before safely passing.

Unfortunately, bicycle laws have done little to reduce the number of bicycle-related accidents and injuries in California. These accidents are quite common and the resulting injuries are often devastating to a victim’s life. These accidents often result in loss of income, emergency care, hospitalization, surgery, and other medical and rehabilitation treatment that can end up costing a small fortune.
